Security Guards at the Slots at Georgian Downs Join PSAC

Forty (40) security guards employed by the Ontario Lottery and Gaming Corporation - Slots at Georgian Downs facility in Barrie, Ontario (OLG) have joined the Public Service Alliance of Canada following a representation vote 24 to 11 in favour of PSAC on September 28, 2006.

The vote became official following the Ontario Labour Relations Board's decision dated March 13, 2007, wherein the Labour Board dismissed the objections raised by the OLG and Georgian Downs Racetrack against PSAC's right to represent security guards at the Slots at Georgian Downs facility.

The Employer had argued that a conflict of interest would arise if PSAC represented the OLG security guards because PSAC also represents Georgian Downs Racetrack employees. The Labour Board, however, found that the extent of any monitoring did not give rise to a conflict of interest within the meaning of the Ontario Labour Relations Act.

UNION ACTION TO BATTLE MYTHS

Anti-union messages are so much a part of our everyday life that we come to accept them without questioning. We never hear how employees’ rights are supported every day by Unions. It is therefore up to us as Union members to speak out when those pesky anti-union myths surface.

RUMOURS

FACT

There is no Union at Georgian Downs Racetrack…

Yes there is. The Union was certified by the Ontario Labour Relations Board on November 9, 2004.

There is no Collective Agreement (Union Contract)between the Employer and Bargaining Unit Members

Yes there is. The Collective Agreement (Union Contract) was voted on and ratified by members September 18, 2006. The Collective Agreement has already been enforced by PSAC in the following areas:

  • Art. 28 - Employee's have been reinbursed for deductions due to shortages
  • Art. 22 - "Layoffs were issued by seniority and written notice" - Employee's were paid their wage where short notice was given.

Because of lay-offs due to the dispute with OHHA and GDL, the
Company does not have to apply the Collective Agreement (Union Contract) provisions for Seniority when scheduling

Yes the company does have to abide by the Seniority provisions set out in the Collective Agreement (Union Contract). The dispute does not and cannot alter the agreed upon provisions between the Company and the Union in the Collective Agreement (Union Contract).

The PSAC is not involved in negotiations between GDL and OHHA-we hope it will be resolved soon so that our members can return to work.

Keep checking this web site for more updates and for our next General Membership Meeting.
If you are a new member remember to sign your Union card contact your PSAC Staff Representative Doug Kosakowski at (416)485-3558
